Cute Creations Design Terms Of Use And Agreement

Please read this document carefully before using any of our software or graphics. These terms are legally binding.
Unless otherwise noted, all Content, (Graphics, Designs, Products, Samples) is copyrighted to and exclusive property of Cute Creations Design and are protected by U.S. and international copyright laws, and Trademarked.
The use of these graphics for anything, besides what is allowed, by this limited licensing agreement requires a separate business license agreement. See License below for details.
You agree to defend and hold harmless Cute Creations Design from and against any and all claims, damages, costs and expenses, including attorneys fees, arising from or related to your use of the Cute Creations Design website and/or products.
Your purchase includes a limited use license for one person, which gives you legal permission to use copyrighted intellectual property (Cute Creations Design Graphics) within the stated parameters of this agreement. Any other use is a violation of federal copyright laws. You do not own the graphics, but have purchased the rights to use them as outlined in this agreement. The creator retains all other rights.
Downloading our graphics or opening the our products indicates your acceptance to abide by the terms of this agreement.

PERSONAL USE
This limited license allows you to use our graphics to create items for your personal use. You may use the graphics to create handmade items to give to others within the restrictions of this agreement.
If you have intentions to use our graphics for another purpose other than personal use, please see the License section below for details.

Nothing on this site is public domain!
Cute Creations Design graphics may be used for personal use in digital crafting and scrapbooking.
You may use our graphics to decorate your web site. However, our graphics may NOT be used where web sites/domains claim ownership of any graphics uploaded to the server.
Please display one of our logos or a text link on EVERY page my graphics are used, and provide a link back to our web site at http://www.cutecreationsdesign.com
You may use our graphics in e-mails as long as you provide a link back to us at our web site at http://www.cutecreationsdesign.com
Our graphics are for family friendly use ONLY. The material (whether it be in text or images) must be appropriate for viewers of ALL ages.
You may NOT exchange money for our software/graphics, unless permission has been granted by the owner, Christine Molnar.
You may NOT alter our software/graphics in any way, unless otherwise noted. This includes changing of wording, colors, or size. Although changing size for personal printables are allowed.
If you would like to have special text on our graphics, please contact us, and I will be happy to help.

LICENSE
If you are interested in obtaining a licensing agreement beyond this limited licensing agreement, you will need to apply for one.
Please submit a written proposal containing what you intend to use our graphics for, an example of the intended use, and where the products will be sold. Please send inquiry to use via our Small Business Application.

PROFESSIONAL CRAFTER
For use of our products with the intention for profit or resale purposes
The Small Business License allows for Cute Creations Design graphics to be used on hand finished products sold directly to the consumer without any copyright infringement. Handcrafted items need to be actual items in which you have created.
Before creating items for resale, you must have a legal license for any graphics you use. You, as the crafter must personally create the item that will be for sale. Please visit our Small Business License information page for complete details and proceedures.

PROFESSIONAL DIGITIZER / DESIGNER
For use of our graphics/products for the intention for profit.
The Small Business License allows for Cute Creations Design graphics to be used to make patterns, digitizing into cross stitch or embroidery, make logos, templates, designs to be printed, digital scrapbook pages (other than personal use), printing on businesses stationery/letterhead, business cards, and use for designing web sites.

DISTRIBUTION
Cute Creations Design graphics may not be distributed in part or whole, in any form including, but not limited to; tubes, linkware, shareware, or web sets. They may not be offered for download as part of a collection, tutorials, or any other digital compilation.
Cute Creations Design graphics cannot be distributed in any digital form as an individual graphic or as a set. You cannot tube or alter a our graphic in any way and then share (distribute) to anyone by any means whether through digital distribution or on CD.
Digital distribution includes, but is not limited to shareware, upload sites or servers, personal websites or personal servers or peer-to-peer networks, online user groups, direct transfers or email.

WARRANTY
Cute Creations Design web site, and all services rendered to our customers are provided "AS IS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED.
Under no circumstances shall Cute Creations Design be liable or responsible for any incidental, indirect or consequential damages of any kind, ncluding, but not limited to, those resulting from loss of use, or data.

The use of Cute Creations Design graphics and/or products, you agree to my Terms of Use when using my graphics.
This is a legal binding contract between yourself and Christine Molnar/Cute Creations Design.
