Please read this document carefully before using any of our graphics/digital products. These terms are legally binding. Unless otherwise noted, all content, (graphics, designs, products, samples) are copyrighted to and exclusive property of Cute Creations Design and the Artists, Christine Molnar and Barbara Scott, and are protected by U.S. and international copyright laws, and Trademarked. The use of our graphics/digital products for anything, besides what is allowed in this agreement requires a separate commercial license agreement. See “Commercial License” below.

 

Your purchase includes a limited use license for one person, which gives you legal permission to use copyrighted intellectual property (Cute Creations Design Graphics/Digital Products) within the stated parameters of this agreement. Any other use is a violation of federal copyright laws. Cute Creations Design/Christine Molnar & Barbara Scott retains all rights of all of our graphics/digital products. Downloading our graphics/digital products or opening our products indicates your acceptance to abide by the terms of this agreement.

 

You may not claim any part or whole of our graphics, designs, artwork, or products.

The use of Cute Creations Design graphics/digital products and/or other products, you agree to our Conditions of Use when using our graphics. This is a legal binding contract between yourself and Christine Molnar/Cute Creations Design. Conditions of Use subject to change without notice

 

PERSONAL USE

You may create digital and handmade items for your own personal use or to give to others within the restrictions of this agreement.

 

If you have intentions to use our graphics/digital products for another purpose other than personal use, please see the “Commercial License” section below for details.

 

Cute Creations Design graphics/digital products may be used for personal use in printing, paper craft projects, digital crafting and scrapbooking. This includes the creation of digital scrapbook pages and hybrid scrapbooking.

 

You may use our Theme Set Graphics to decorate your web site. However, our graphics may not be used where web sites/domains claim ownership of any graphics uploaded to the server. One of our logos or a text link must be visible on every page where our graphics are used, and provide a link back to our web site at http://www.cutecreationsdesign.com.

 

You may use our graphics in e-mails as long as you provide a link back to us at our web site at http://www.cutecreationsdesign.com.

 

Our graphics are for family friendly use ONLY. The material (whether it be in text or images) must be appropriate for viewers of ALL ages.

 

You may not resell or exchange money for our graphics/digital products. However, our Commercial License allows you to sell products where our artwork is used. See “Commercial License” below.

 

You may not alter our graphics in any way, unless otherwise noted (see below for digital stamps). This includes changing of wording and colors. Although changing size for personal printables are allowed. If you would like to have special text on our graphics, please contact us, and we will be happy to help.

 

Digital Stamps may be re-sized, flipped, rotated and colored in the creation of your digital and printable crafts, stamping projects and scrapbook page.

 

 

COMMERCIAL LICENSE

Commercial License holders can use our graphics/digital products to create products to resell for profit. Some examples include: handmade greeting cards, scrapbook pages, digital scrapbook pages, photographers who will use our graphics/digital products in combination with photographs, printables, stationery, crafts, making patterns, digitizing into cross stitch or embroidery, for use to make logos, templates, designs to be printed, such as stationery, business cards, labels, and designing web sites.

 

We must have a signed agreement on file if you intend to use our graphics/digital products for any use other than personal.

 

We require you to submit a written proposal containing what you intend to use our graphics for, an example of the intended use, and where the products will be sold, or submit your intentions of use in the comments section of our Small Business License Application which can be found on our website at:

By purchasing our Small Business License, you are purchasing a legal 'permission' to use our artwork in your business designs, craft products, professional scrapbook designs, advertisements, or web designing for profit. All copyrights on each and every image remains with Cute Creations Design/Christine Molnar & Barbara Scott.

Requirements:
You must agree to our conditions of use before purchasing our Small Business License.
A credit link must be shown where ever our graphics were/are used.
Our Small Business License must be purchased prior to, or at the same time as purchasing graphic collections.

 

 

DISTRIBUTION

Cute Creations Design graphics/digital products may not be distributed in part or whole, in any form including, but not limited to; tubes, linkware/freeware, shareware, or web sets. They may not be offered for download as part of a collection, tutorials, or any other digital compilation.

 

Cute Creations Design graphics/digital products cannot be distributed in any form as an individual graphic/digital product or as a set. You cannot tube or alter our graphics/digital products in any way and then share (distribute) to anyone by any means whether through digital distribution or on CD.

 

Digital distribution includes, but is not limited to shareware, upload sites or servers, personal websites or personal servers or peer-to-peer networks, online user groups, direct transfers or email.

 

 

WARRANTY

Cute Creations Design web site, and all services rendered to our customers are provided "AS IS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED.

Under no circumstances shall Cute Creations Design be liable or responsible for any incidental, indirect or consequential damages of any kind, including, but not limited to, those resulting from loss of use, or data.

 

 

You agree to defend and hold harmless Cute Creations Design from and against any and all claims, damages, costs and expenses, including attorney fees, arising from or related to your use of the Cute Creations Design website and/or products.
